Recent Obama nominee to the Supreme Court, Sonia Sotomayor, makes an appalling admission to anyone who feels that the Constitution is more than just a piece of paper. Apparently, Sotomayor says, appellate courts are where policy is made. This might come as a surprise to Congress, but the crowd just laughs appreciatively.

Never fear, strict constructionalists. The Believability Meter doesn't buy Sotomayor's posturing for a second. She might be happy to feed a cheap applause line to a self-important law school crowd, but Sotomayor knows that policy still gets made in the legislature, not on the second circuit. Or at the very least, it gets made in the Supreme Court, which by the way has overturned upwards of 60% of the Sotomayor decisions it has considered. Was Sotomayor a good choice for President Obama?
